1 Tenant Rights When Your Landlord Has Been Foreclosed On This pamphlet explains your rights and obligations as a tenant when your landlord is foreclosed on and a new owner buys the rental property at a sheriff ’s sale. What is foreclosure? Foreclosure is the legal process a bank uses to repossess property. The bank sues the landlord, gets a court decision that allows it to sell the property and use the money from the sale to pay off the mortgage. This process usually takes several months.
